1. Information We Collect
We collect information in three primary ways: information you provide directly, information collected automatically, and information from third-party services.
Account Information: When you register as a Creator or Customer, we collect basic profile details including your name, email address, profile picture, and social media handles.
Financial & Payment Data (Crucial Notice): We do NOT collect, process, or store your credit card numbers, bank details, or direct payment information on our servers. All financial transactions are securely processed by compliant third-party payment gateways (such as Stripe, PayPal, or Lemon Squeezy). Your payment data is subject strictly to their respective privacy policies and security standards.
Communications: If you contact our support team, report bugs, or request features, we collect the contents of those communications to assist you.
Technical & Usage Data: As you navigate Mbird, we automatically collect metadata such as IP addresses, browser types, device identifiers, referring URLs, and interaction metrics. We use this strictly to optimize platform performance and monitor for security threats.
Cookies & Local Storage: We use essential session cookies and local storage tokens (e.g., HTTP-only JWTs) to authenticate your login sessions and secure your account. We do not use intrusive third-party advertising trackers.
2. How We Use Your Information
Our primary goal in collecting information is to operate the Mbird platform securely and reliably. Specifically, we use your data to:
• Provide, maintain, and improve the core functionalities of the Service.
• Process digital product deliveries and route custom domain traffic.
• Authenticate users and prevent unauthorized access or fraudulent transactions.
• Provide technical support and respond to user inquiries.
• Analyze platform usage trends to design better features.
AI & Automation Disclaimer: If you use our Instagram automation features, your messaging data is processed strictly to execute your requested automated flows. We do NOT use your private data, customer conversations, or prompts to train any general Artificial Intelligence (AI) models.
3. Information Sharing & Third Parties
We respect your privacy and will never sell your personal data to data brokers or advertising networks. We only share information under the following strict conditions:
Infrastructure Providers: We share limited technical data with our trusted server hosting, database, and authentication providers (e.g., Vercel, Convex, Clerk) strictly for the operational functionality of Mbird.
Between Creators and Customers: When a Customer purchases a digital product from a Creator's storefront, the Customer's name and email address are shared with that specific Creator. This is necessary for product delivery, support, and the Creator's legitimate business operations. Mbird is not responsible for, nor do we control, how individual Creators manage, store, or use this shared data.
Legal Compliance: We may disclose your information if required by law, court order, or governmental request, or when we believe in good faith that disclosure is necessary to protect the safety, rights, or property of the Operators, our users, or the public.
4. Your Privacy Rights
Depending on your geographic location (e.g., under the GDPR in Europe or CCPA in California), you possess specific rights regarding your personal data:
• Right to Access: You may request a copy of the personal data we hold about you.
• Right to Rectification: You may update or correct your profile information at any time within your account dashboard.
• Right to Erasure: You may request the permanent deletion of your account and associated personal data from our active databases.
To exercise these rights, please contact us from your registered email address. We will verify your identity and process your request within the legally mandated timeframes.
5. Data Security & Limitations of Liability
We implement commercially reasonable, industry-standard security measures (including HTTPS encryption, HTTP-only cookies, and secure database indexing) to protect your data. However, you acknowledge that Mbird is currently operated by independent developers in a pre-corporate phase.
Therefore, you understand and agree that no internet transmission or electronic storage is 100% secure. The Operators assume no legal or financial liability for data breaches, unauthorized server access, or cyberattacks that occur despite our security efforts. You use the Service and entrust your data to the platform entirely at your own risk.
6. Children's Privacy
Mbird is not directed to individuals under the age of 16. We do not knowingly collect personal data from children under 16. If we become aware that we have inadvertently collected such information, we will take immediate steps to delete it from our servers.
7. Modifications to This Policy
As our platform grows and transitions into a formal corporate entity, this Privacy Policy may be updated. We will post any changes on this page and update the "Last Revision" date. Your continued use of the Service after such modifications constitutes your acknowledgment and acceptance of the updated policy.
